Mcleod County ASST COUNTY ATTORNEY I, II or SR ASSISTANT COUNTY ATTORNEY in Glencoe, Minnesota

The Assistant County Attorney/Sr Assistant County Attorney performs professional work preparing and prosecuting cases on behalf of the State of Minnesota in McLeod County. This position requires the individual to appear in court, advise law enforcement, and to render legal assistance and opinions countywide. The Assistant County Attorney drafts policies, procedures, ordinances, contracts and legal documents, prepares reports, while maintaining applicable records and files. Work is performed under the general direction of the County Attorney. Position Duties Review charges, evidence and facts; prosecute felonies, misdemeanors, and juvenile delinquency matters. Evaluate evidence and facts to determine whether to proceed with legal action, charges, dismissal or negotiations. Try assigned criminal, civil, and juvenile cases. Prepare cases for judicial and administrative proceedings, including processing of all interviewing, investigation, research, subpoenas, written legal memoranda and opposition analysis. interview clients and witnesses, investigate facts, research applicable law, subpoena witnesses, analyze opposition s cases. Draft petitions, complaints, court orders, judgments, findings of fact, stipulations, and other legal, civil or criminal documents and pleadings. Represent all County departments, clients and others in all applicable legal matters, including reviewing files; drafting complaints and litigation documents; engaging in negotiation; reviewing and drafting contracts; researching and preparing memoranda; interviewing witnesses; and appearing in court. Respond to requests for legal advice from County agencies, departments and law enforcement. Represent the County in child and adult protection, child support, parental rights, adoptions, placements, conservatorships/guardianships and civil commitments. Represent the State and County in all stages of appeal including preparation of appellate briefs in criminal, juvenile, and child protection appeals; manages all Human Services related appeals. Provide training sessions to applicable County staff and agencies as required. Represent the County at judicial hearings by presenting facts, analyzing evidence and information as it is conveyed during proceedings, adjust the County's case as necessary. Handle appellate matters by recommending whether to appeal a case, analyzing issues, reviewing transcripts, conducting legal research, drafting briefs, and making an oral argument to appellate courts. Negotiate contracts, leases, lawsuit settlements, or similar legal matters by assessing the client's needs, evaluating the strengths and weaknesses of the client's and opponent's bargaining positions, and meeting with the opponent's representatives so that the client's objectives can be reached at minimal cost. Draft and review contracts, bids, ordinances, and similar legal agreements to ensure they meet legal requirements. Prepare legal opinions and plans for litigation to resolve immediate issues and to establish a basis for resolving future matters of a similar nature. Train and advise staff and others involved in County legal proceedings. Assist Assistant County Attorney IIs, the County Attorney, and other support staff. Train and provide advice to law enforcement officers, attorneys, corrections workers, social workers, and other relevant parties in areas of investigation, trial techniques, criminal law, civil law, juvenile law, strategy, and pertinent legal issues. Represent the County Attorney in meetings of boards, advisory committees, task forces, and similar organizations. Perform all duties under the direction of the McLeod County Attorney. Personnel Administration Support and assist the County Attorney as needed in direction and evaluation of County Attorney s office support staff. Skill in conducting legal research, analyzing legal problems, and rendering formal opinions. Skill in analyzing facts, evidence, and legal instruments. Knowledge of applicable software applications. Ability to work independently with minimal supervision. Ability to exercise sound judgment in decision-making. Ability to organize and prioritize tasks. Ability to communicate effectively and strong public relations skills. Ability to establish and maintain effective working relationships.
